Platform Terms of Use

Version 5

Section A: Platform Role

The Platform is a technology service that facilitates information sharing between clients and independent insurance agents. The Platform does not provide insurance advice, quotes, or recommendations. The Platform does not endorse or recommend any particular agent. All quotes, coverage decisions, and policy terms are provided solely by the independent agents and their respective insurance carriers.

Section B: Eligibility

You must be at least eighteen (18) years of age to create an account and use the Platform. By accepting these terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

Section C: Client Data Consent

You authorize the Platform to collect, store, and process your personal and insurance-related information, including identity information (such as name, date of birth, driver's license number, and last four digits of your Social Security number), contact information, and policy documents, for the purpose of facilitating insurance quotes and policy placement.

Section D: Sharing Authorization

You control when and to whom your information is shared. By selecting an agent and initiating a share action, you authorize the Platform to disclose the selected information and documents to that agent. Information is only shared with agents you have explicitly selected or been matched with through the Platform.

Section E: Revocation & Limits

You may revoke an agent's access to your information at any time. Revocation prevents future access but does not require deletion of information already lawfully obtained by the agent prior to revocation. Once information has been viewed or downloaded by an agent, the Platform cannot guarantee its removal from systems outside the Platform.

Section F: Accuracy Responsibility

You are responsible for the accuracy and completeness of all information submitted to the Platform, including identity information, contact details, and insurance documents. The Platform does not independently verify the information you provide unless explicitly stated. Inaccurate information may result in incorrect quotes or coverage issues.

Section G: AI-Generated Content Disclaimer

The Platform uses artificial intelligence to read factual information from insurance documents (such as coverage limits, deductibles, and premium amounts) and to present that data in a structured, side-by-side format. AI features do not interpret, evaluate, or compare those details, and do not provide insurance advice, recommendations, opinions, or endorsements. Coverage details shown with a quote come from the quote a licensed agent submitted and reviewed: the agent affirms those details as their own quote when submitting, and again when editing a submitted quote, and the Platform does not verify them. Coverage details read from documents you upload yourself have no licensed reviewer and may contain errors, omissions, or inaccuracies. You are responsible for confirming coverage details against the source document before you rely on them, and you should not rely on AI-generated summaries or data presentations as a substitute for reading your actual policy documents or consulting with a licensed insurance agent. The Platform is not responsible for any decisions made based on AI-generated content.

Section H: No Guarantee of Outcomes

The Platform does not guarantee that you will receive quotes, coverage, or favorable terms from any agent. Insurance availability, pricing, and eligibility are determined solely by the agents and their carriers based on the information you provide and their underwriting criteria.

Section I: Security & Risk Disclosure

While the Platform uses reasonable security measures to protect your information, no system is completely secure. You acknowledge and accept the inherent risks of transmitting personal information electronically. The Platform will notify you in accordance with applicable law in the event of a data breach affecting your information.

Section J: Communications & Records

Communications sent through the Platform's messaging system may be stored and reviewed for quality assurance, compliance, and dispute resolution purposes. These messages are Platform records. You consent to such storage and review as a condition of using the Platform's communication features.

Section K: Electronic Signature Consent

By clicking "Accept Terms" you consent to conduct this transaction electronically in accordance with the federal Electronic Signatures in Global and National Commerce Act (ESIGN Act) and applicable state Uniform Electronic Transactions Acts (UETA). Your electronic acceptance of these terms has the same legal force and effect as a handwritten signature. You may withdraw this consent at any time by deleting your account, but withdrawal will not affect the validity of any electronic signature made prior to withdrawal.

Section L: Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POLICYVERA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR COVERAGE, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR USE OF THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY. THE PLATFORM'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.

Section M: Dispute Resolution & Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of laws provisions. Any dispute arising out of or relating to this agreement shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association in Meridian, Idaho. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.

Section N: Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against PolicyVera LLC. If for any reason a claim proceeds in court rather than in arbitration, you and PolicyVera LLC each waive the right to a jury trial. If any court or arbitrator determines that this class action waiver is void or unenforceable for any reason, or that an arbitration can proceed on a class basis, then the arbitration provision in Section M shall be deemed null and void in its entirety, and the parties shall be deemed to have not agreed to arbitrate disputes.

Section O: Termination

Either party may terminate this agreement at any time. The Platform may suspend or terminate your access for misuse, fraud, submission of false information, or violation of these terms. Upon termination, your data will be handled in accordance with the Platform's privacy policy and applicable data retention laws. Sections G (AI Disclaimer), L (Limitation of Liability), M (Dispute Resolution), and N (Class Action Waiver) shall survive termination.

Section P: Publicity & Feedback

You grant PolicyVera a non-exclusive, worldwide, royalty-free permission to use your name, photo, and likeness, and any reviews, feedback, or testimonials you provide about the Platform itself, whether submitted on the Platform, sent to PolicyVera directly, or posted publicly — on the Platform and in PolicyVera marketing and promotional materials, with or without attribution. You further agree that PolicyVera may freely use any suggestions, ideas, or feedback you provide about the Platform to improve its products and services, without compensation or obligation to you. You may withdraw the publicity permissions in this section at any time by emailing legal@policyvera.com, and PolicyVera will stop the use.
